Terms of Use

By creating an account, signing in (including with Google), purchasing credits, or otherwise using the Services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.

You must be at least 18 years old (or older, if the age of majority where you live is higher) to use the Services. When you create an account we ask you to confirm this, and we record that confirmation. You represent that you have the legal capacity to enter into these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or pose a security risk.

You are solely responsible for any images, prompts, files, or other materials you upload and for any outputs you generate, download, or distribute using the Services. You must comply with applicable laws and third-party rights.

You warrant that you own or have obtained all necessary rights, licenses, and consents (including from any people depicted) to upload and use your content with the Services. You will not upload content that infringes intellectual property, privacy, publicity, or other rights of any person.

You agree not to use the Services to:

• Violate any law or regulation;
• Harass, abuse, defame, or harm others;
• Generate or distribute illegal, fraudulent, hateful, violent, sexually exploitative, or deceptive content;
• Infringe intellectual property or other proprietary rights;
• Attempt to gain unauthorized access to our systems, other users' accounts, or third-party services;
• Reverse engineer, scrape, or overload the Services except as permitted by law;
• Use the Services to build a competing product or to train external models on our outputs without permission;
• Misrepresent AI-generated content as human-created where such misrepresentation is unlawful or harmful.

Sexual content involving minors — zero tolerance.

You must not use the Services to create, request, upload, modify, process, publish, distribute or otherwise facilitate sexual or sexually suggestive content involving a minor. This prohibition applies regardless of whether the depicted character is a real person, AI-generated character, illustration, animation, three-dimensional character, fictional character or any other visual representation. You must not create or request sexual content involving a character who:

• is stated to be under 18;
• reasonably appears to be under 18;
• is presented as a child, teenager, school student or in another context indicating minority;
• is given physical, descriptive or contextual characteristics intended to make the character appear underage; or
• is described using wording designed to circumvent the age restriction while still depicting the character as underage.

Statements such as “the character is actually 18,” “the character is hundreds of years old,” “the character is legally an adult,” or similar age disclaimers will not make content permissible where the character is otherwise depicted, described or presented as a minor. Any violation of this prohibition may result in immediate and permanent account suspension or termination, removal of content and any other action permitted or required by applicable law.

Outputs are generated by artificial intelligence and may be inaccurate, incomplete, or unintended. You are responsible for reviewing outputs before use or publication. We do not guarantee that outputs will meet your requirements or be suitable for any particular purpose.

Certain features require credits or paid packs. Prices, credit rules, and consumption (for example, credits per video length) are described at the point of purchase or in the product interface. Payments are processed by third-party providers; their terms may also apply. Except where required by law, fees are generally non-refundable. Credits do not expire — a balance you have paid for stays on your account until you spend it.

Videos and images you generate are stored and available for download for 7 days from the moment the generation completes. After that they are permanently deleted and cannot be recovered. The source files you uploaded are deleted with them.

You are responsible for downloading anything you want to keep. Credits you spent on a generation are not returned when it expires — you paid for the generation, and it ran. The retention period is described in our Privacy Policy, which also says what we keep after the media is gone.

We strive to keep the Services available but do not guarantee uninterrupted or error-free operation. Maintenance, updates, third-party outages, or force majeure events may cause downtime. We are not liable for any loss arising from unavailability.

We may suspend or terminate your access to the Services at any time if you breach these Terms, if we are required to do so by law, or if we discontinue the Services (with reasonable notice where practicable). You may stop using the Services at any time. Provisions that by their nature should survive will survive termination.

The Services, including software, branding, and documentation, are owned by XMAKU or its licensors and are protected by intellectual property laws. Subject to these Terms and applicable law, you may own rights in your inputs and may receive a license to use outputs as described in our product terms; we do not claim ownership of your uploads except as needed to operate the Services.

To the maximum extent permitted by applicable law, XMAKU and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Services. Our total liability for any claim arising out of these Terms or the Services is limited to the greater of (a) the amount you paid us for the Services in the twelve (12) months before the claim or (b) one hundred U.S. dollars (USD $100), except where liability cannot be limited by law.

You will defend, indemnify, and hold harmless XMAKU and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Services, or your violation of these Terms or applicable law.

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country apply. The competent courts of Israel shall have exclusive jurisdiction, subject to mandatory provisions of law.

We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. If changes are material, we may provide additional notice (for example, by email or in-app). Continued use after the effective date constitutes acceptance of the revised Terms, where permitted by law.
