Terms of Use

By creating an account, signing in (including with Google), purchasing credits, or otherwise using the Services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.

You must be at least the age of majority in your jurisdiction (and in any case at least 16 years old, or older if required where you live) to use the Services. You represent that you have the legal capacity to enter into these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or pose a security risk.

You are solely responsible for any images, prompts, files, or other materials you upload and for any outputs you generate, download, or distribute using the Services. You must comply with applicable laws and third-party rights.

You warrant that you own or have obtained all necessary rights, licenses, and consents (including from any people depicted) to upload and use your content with the Services. You will not upload content that infringes intellectual property, privacy, publicity, or other rights of any person.

You agree not to use the Services to:

• Violate any law or regulation;
• Harass, abuse, defame, or harm others;
• Generate or distribute illegal, fraudulent, hateful, violent, sexually exploitative, or deceptive content;
• Infringe intellectual property or other proprietary rights;
• Attempt to gain unauthorized access to our systems, other users' accounts, or third-party services;
• Reverse engineer, scrape, or overload the Services except as permitted by law;
• Use the Services to build a competing product or to train external models on our outputs without permission;
• Misrepresent AI-generated content as human-created where such misrepresentation is unlawful or harmful.

Outputs are generated by artificial intelligence and may be inaccurate, incomplete, or unintended. You are responsible for reviewing outputs before use or publication. We do not guarantee that outputs will meet your requirements or be suitable for any particular purpose.

Certain features require credits or paid packs. Prices, credit rules, and consumption (for example, credits per video length) are described at the point of purchase or in the product interface. Payments are processed by third-party providers; their terms may also apply. Except where required by law, fees are generally non-refundable. Credits may expire or be subject to fair-use rules as we disclose in the Services.

We strive to keep the Services available but do not guarantee uninterrupted or error-free operation. Maintenance, updates, third-party outages, or force majeure events may cause downtime. We are not liable for any loss arising from unavailability.

We may suspend or terminate your access to the Services at any time if you breach these Terms, if we are required to do so by law, or if we discontinue the Services (with reasonable notice where practicable). You may stop using the Services at any time. Provisions that by their nature should survive will survive termination.

The Services, including software, branding, and documentation, are owned by MAKUAI or its licensors and are protected by intellectual property laws. Subject to these Terms and applicable law, you may own rights in your inputs and may receive a license to use outputs as described in our product terms; we do not claim ownership of your uploads except as needed to operate the Services.

To the maximum extent permitted by applicable law, MAKUAI and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Services. Our total liability for any claim arising out of these Terms or the Services is limited to the greater of (a) the amount you paid us for the Services in the twelve (12) months before the claim or (b) one hundred U.S. dollars (USD $100), except where liability cannot be limited by law.

You will defend, indemnify, and hold harmless MAKUAI and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Services, or your violation of these Terms or applicable law.

These Terms are governed by the laws of [Your jurisdiction], without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country apply. Courts in [Venue] shall have exclusive jurisdiction, subject to mandatory provisions of law.
